TERMS OF SERVICE

These Terms of Service govern your access to and use of the Marlow & Co. online store, including all purchases made through the store.

By visiting the store, creating an account, or purchasing a product, you agree to these Terms of Service. If you do not agree, do not use the store.

  1. ABOUT THE STORE

Marlow & Co. operates this online store using Shopify. Certain products are stored, processed, or shipped by third-party suppliers and fulfillment providers, including CJdropshipping.

References to “we,” “us,” and “our” mean Marlow & Co. References to “you” and “your” mean the customer or visitor using the store.

  1. ELIGIBILITY

You must be legally capable of entering into a binding agreement in your jurisdiction to place an order.

You must provide current, complete, and accurate information when purchasing from the store. You may not use the store for any unlawful, fraudulent, abusive, or unauthorized purpose.

  1. PRODUCTS AND INFORMATION

We make reasonable efforts to display product descriptions, photographs, colors, specifications, dimensions, and prices accurately.

Actual colors may vary because of lighting, photography, manufacturing batches, and screen settings. Measurements may have minor tolerances. Product packaging may change without notice.

We may correct errors, inaccuracies, or omissions and update product information at any time. If a material error affects an order you have already placed, we may contact you for instructions or cancel and refund the affected item.

  1. AVAILABILITY

Products are subject to availability. Inventory information can change between the time an order is placed and the time fulfillment begins.

We may limit quantities, discontinue products, reject an order, or cancel an unavailable item. If we cancel a paid item, we will refund the amount paid for that item.

  1. PRICES AND PAYMENT

Prices are displayed in the currency shown on the store. Unless stated otherwise, shipping charges, customs duties, import fees, VAT, and other taxes may be added separately.

You agree to provide valid payment and billing information. An order is not accepted until payment is successfully authorized and we confirm or begin processing the order.

Your bank or payment provider may charge currency-conversion or international-transaction fees. Marlow & Co. does not control and is not responsible for those charges.

  1. ORDER ACCEPTANCE AND CANCELLATION

An order-confirmation email acknowledges receipt of your order but does not guarantee acceptance.

We may cancel or limit an order because of suspected fraud, pricing errors, inventory unavailability, shipping restrictions, payment problems, or other reasonable operational concerns.

Customers may request cancellation before fulfillment begins. Once an order has been processed, packed, or dispatched, it cannot normally be cancelled or changed.

  1. SHIPPING AND DELIVERY

Orders may be fulfilled and shipped by third parties from domestic or international warehouses.

All delivery dates are estimates. Delays may occur because of customs, carriers, weather, stock availability, peak periods, public holidays, transportation disruption, or circumstances outside our reasonable control.

Customers are responsible for providing a complete delivery address, monitoring tracking, responding to carrier notices, collecting held parcels, and paying applicable import charges unless stated otherwise.

Our Shipping Policy forms part of these Terms.

  1. RETURNS, REFUNDS, AND REPLACEMENTS

Returns, refunds, cancellations, and replacements are governed by our Refund and Return Policy, which forms part of these Terms.

Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable consumer-protection law.

  1. ACCOUNTS

If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account.

Notify us promptly if you believe your account has been accessed without authorization.

  1. ACCEPTABLE USE

You must not:

• Use the store for unlawful or fraudulent activity;
• Introduce malware, malicious code, or harmful automated requests;
• Attempt to bypass security or access restricted systems;
• Scrape, copy, or exploit store content without authorization;
• Impersonate another person;
• Submit false payment, delivery, refund, or dispute information;
• Interfere with the operation of the store; or
• Infringe another person’s rights.

We may restrict or terminate access when these rules are violated.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the store’s branding, layout, text, graphics, logos, and original content belong to Marlow & Co. or are used under license.

You may use the store only for personal shopping and other lawful, non-commercial purposes. You may not reproduce, distribute, modify, sell, or commercially exploit protected store content without written permission.

  1. THIRD-PARTY SERVICES AND LINKS

The store may use or link to services operated by Shopify, payment providers, carriers, suppliers, fulfillment providers, analytics services, or other third parties.

Those services may be governed by separate terms and privacy policies. We are not responsible for third-party websites or services outside our reasonable control.

  1. REVIEWS AND SUBMISSIONS

If you submit a product review, photograph, comment, suggestion, or other content, you confirm that:

• You have the right to submit it;
• It is accurate and not misleading;
• It does not violate another person’s rights;
• It is not unlawful, threatening, defamatory, obscene, or abusive; and
• It does not contain malware, spam, or unauthorized advertising.

You grant Marlow & Co. a non-exclusive, worldwide, royalty-free license to display and use that content in connection with the store and its marketing, subject to applicable law.

  1. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy.

  1. DISCLAIMER

To the maximum extent permitted by law, the store and its content are provided on an “as available” basis. We do not guarantee that access will always be uninterrupted, error-free, or secure.

Product warranties are limited to those expressly stated on the applicable product page or required by law.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Marlow & Co. will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the store or products purchased through it.

Where liability cannot be excluded, our total liability relating to a product will not exceed the amount paid for that product, except where applicable law requires otherwise.

This section does not exclude liability that cannot legally be limited or excluded.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to compensate Marlow & Co. for reasonable losses, claims, or expenses resulting from your unlawful use of the store, breach of these Terms, infringement of another person’s rights, or fraudulent conduct.

  1. SEVERABILITY

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the minimum extent required. The remaining provisions will continue to apply.

  1. NO WAIVER

A failure to enforce any provision of these Terms does not waive our right to enforce it later.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect operational, legal, or regulatory changes. The revised version will be posted on the store with a new “Last updated” date.

Changes will apply prospectively unless applicable law requires otherwise.

  1. GOVERNING LAW

These Terms are governed by the laws applicable to Marlow & Co.’s place of business, without limiting any mandatory consumer rights available in the customer’s country or region.
